Respondent was assessed a civil penalty of $13,350 for two violations of the HMR, when (1) it offered a quantity of hazardous materials that requires placarding when it had failed to register with PHMSA and pay the registration fee, and (2) it offered for transportation in commerce unpackaged surface contaminated object (SCO-I) materials while failing to take measures to ensure radioactive material would not be released into the environment or the conveyance.

Respondent was assessed a civil penalty of $50,000 for one (combined) violation of the HMR when it offered a Type B quantity of a radioactive hazardous material for transportation in commerce but failed to use a Type B package or, in the alternative, obtain a special permit authorizing the shipment of this material, and it misdescribed the packaging as 25 Type A packages which did not meet the requirements for a Type A package and were not marked as required for a Type A package.
