Respondent was assessed a civil penalty of $7,400 for five violations of the HMR when it offered for transportation in commerce fireworks, a Class 1 (explosive) hazardous material (1) in a package marked as meeting a UN performance standard in the HMR when the package had not been closed to bring it in conformance with the manner in which it had been tested and certified, thus voiding the UN certification and making it an unauthorized packaging; (2) when its employees who packaged fireworks for transportation in commerce had not received function-specific training; (3-4) accompanied by shipping papers which, in numerous instances, failed to include an emergency response telephone number, the number and/or type of packages, the UN identification number, the correct division number, and/or the packing group; and (5) in packages that were not marked with an EX number and which were not accompanied by shipping papers containing an EX number.
