Respondent was assessed a civil penalty of $16,023 for five violations of the HMR, when it offered for transportation in commerce Hydrogen peroxide, aqueous solution with more than 40 percent but not more than 60 percent hydrogen peroxide (stabilized as necessary), in unauthorized, non-bulk packagings (violation 1) that were not marked with a proper hazard class warning labels (violation 2) or proper shipping name (violation 4), were accompanied by shipping documents that improperly described the material and listed a phone number for an organization that had not accepted responsibility for providing detailed information concerning the hazardous material (violation 3), and when Appellant failed to provided hazmat employee training to employees who performed functions subject to the HMR (violation 5).
