Respondent was assessed a civil penalty of $13,250 for one violation of the HMR when it offered for transportation in commerce safety fuses, a Class 1 explosive device, which had not been examined by a laboratory authorized by PHMSA to conduct explosives classification testing and approved by PHMSA, and Respondent (1) failed to properly describe the fuses on a shipping paper or mark the packagings with the proper shipping name and identification number of the fuses; (2) marked the packagings with EX numbers which had been issued for other explosive articles when an EX number had not been issued for these fuses; and (3) affixed incorrect hazard division warning labels to the packagings.
