Mr. Joe Cleveland                     Reference No. 05-0118
125 Kossuth Street
Piscataway, NJ 98854

Dear Mr. Cleveland,

This is in response to your letter dated April 29, 2005, requesting clarification of the shipping paper requirements for elevated temperature materials under the Hazardous Materials Regulations (HMR; 49 CFR Parts 100-1 85). Specifically, you request a letter confirming that the proper shipping name “Elevated temperature solid n.o.s.” does not require the addition of the qualifying word “HOT” immediately preceding the proper shipping name because the words “Elevated temperature” is part of the proper shipping name.

Your understanding is correct. In accordance with § 172.203(n) the word “HOT’ is not required to precede the proper shipping name of an elevated temperature material if the proper shipping name includes the words “Molten” or “Elevated temperature.” You may enter the word “HOT’ on the shipping paper as additional information following the basic description required by § 172.202 and any applicable additional descriptions required by § 172.203.

I hope this information is helpful. Please contact us if you require additional assistance.

Sincerely,

John A. Gale
