Respondent was assessed a civil penalty of $20,590 for five violations of the HMR when it filled, shipped, and transported US DOT 4BW240 and 4E240 specification cylinders with compressed gas, when the cylinders are out of test; transported in commerce a bulk quantity of Hazard Class 2.1 hazardous material, while having failed to develop a security plan; allowed employees to perform a function subject to the requirements of the Federal hazardous materials regulations when the employees had not received initial hazardous materials training in the areas of general awareness, function-specific, safety and security awareness, and in-depth security; offered for and transporting in commerce a hazardous material as a private motor carrier while having failed to retain copies of shipping papers as required; and offered for and transporting in commerce a hazardous material accompanied by a shipping paper which included additional information interspersed within the basic description.
