Respondent was assessed a civil penalty of $10,975 for four violations of the HMR when it offered for transportation and transporting in commerce a quantity of hazardous material in a Large Bulk Quantity under the provisions of the Hazardous Materials Regulations, "UN1075, Liquefied Petroleum Gas, 2.1," as prescribed by 49 CFR § 172.800, while failing to develop a written security plan; allowed employees to perform a function subject to the requirements of federal hazardous materials regulations while failing to provide required hazardous materials training (initial and recurrent) to hazmat employees (general awareness, function-specific, safety, security awareness and in-depth security training); offered for transportation in commerce a hazardous material, while failing to provide properly completed hazardous materials shipping papers, and which included additional unauthorized information, as prescribed by 49 CFR § 172.200; and offered for transportation in commerce a hazardous material, while failing to retain hazardous materials shipping papers or record of shipment, as prescribed by 49 § CFR 172.201.
