The Chief Counsel's findings were affirmed. Appellant was assessed a civil penalty of $4,080. Appellant must pay the civil penalty within 30 days of the date of the decision. In the Chief Counsel's order, Respondent was assessed a civil penalty of $4,080 for three violations of the HMR when it offered for transportation, in commerce, a hazardous material (UN1263, Paint, 3, PG II), while failing to register as a shipper of hazardous materials; offered for transportation, in commerce, a hazardous material (UN1263, Paint, 3, PG II), when the UN packaging had not been closed in accordance with the manufacturer's closure instructions; and offered for transportation, in commerce, a hazardous material (UN1263, Paint, 3, PG II), while failing to provide initial and recurrent hazardous materials training to hazmat employees.
