The Chief Counsel's findings were affirmed. Appellant was assessed a reduced civil penalty of $1,500 based on Appellant's ability to pay. Appellant may pay the civil penalty in one lump sum OR over the course of 12 months with 12 monthly payments of $500.00, every four months, beginning within 30 days of the date of the Decision, until the entire civil penalty is paid in full. In the Chief Counsel's order, Respondent was assessed a civil penalty of $16,000 for one violation of the HMR when it offered for transportation in commerce a shipment of a hazardous material (UNTO18, Refrigerant gas R22, 2.2), in packaging without shipping papers, marking, and labeling, therefore shipping a hazardous material undeclared.
