Respondent was assessed a civil penalty of $6,380 for three violations of the HMR when it distributed UN standard IBCs while failing to notify in writing each person to whom a packaging is transferred of all requirements not met at the time of transfer, including closure instructions; allowed employees to perform functions subject to the requirements of the HMR, while failing to provide general awareness, function-specific, and security awareness training to hazmat employees; and represented and certified UN standard IBCs as meeting the requirement of the HMR, while failing to keep records of periodic retest and inspection for each packaging.
