Respondent was assessed a civil penalty of $6,175 for four violations of the HMR when it (a) offered for transportation in commerce a hazardous material, cruise ship flares approved under EX2002040259, in outer packagings to which the warning label required by the approval was not affixed and it had not provided comprehensive emergency response and mitigation information to the organization which had accepted responsibility for providing detailed information concerning the hazardous materials shipped by Respondent (violations Nos. 2 & 3), and (b) accepted and transported a hazardous material, cylinders containing carbon dioxide, which were not properly secured on RespondentÂ’s vehicle and were not accompanied by a shipping paper properly describing the material (violations Nos. 4 & 5). Alleged violation No. 1 dismissed.
