The Chief Counsel found that United Parcel Service committed one violation of the HMR, when it represented, marked and certified DOT specification 3HT cylinders as having been successfully retested after it had failed to assure the accuracy of its retest equipment because its calibrated cylinder showed permanent expansion. The order explains that "no permanent expansion" does not allow for a range of accuracy; permanent expansion of the calibrated cylinder must be zero. The order also explains that the standard is the same irrespective of the type of equipment being used (burette or digital readout). The order assessed a civil penalty in the amount of $6000.00.
