Respondent was assessed a civil penalty of $92,100 for five violations of the HMR when it represented, marked, certified, and offered DOT-specification cylinders as being properly requalified, when the cylinders were not subjected to the required hydrostatic pressure testing, and the markings were conducted by a person who was not approved by the Associate Administrator for Hazardous Materials Safety; it offered and caused to be filled DOT-specification cylinders with a hazardous material (UN1013, Carbon dioxide, 2.2), while out of test, and in unauthorized packaging; it offered for transportation, in commerce, a hazardous material (UN1013, Carbon dioxide, 2.2), in a quantity that requires placarding, while failing to register as an offeror of hazardous materials; it offered for transportation, in commerce, a hazardous material (UN1013, Carbon dioxide, 2.2), while failing to prepare hazardous materials shipping papers; and it offered, for transportation, in commerce, a hazardous material (UN1013, Carbon dioxide, 2.2), when hazardous materials employees had not received general awareness, function-specific, safety, and security awareness training.
