Respondent was assessed a civil penalty of $7,200 for two violations of the HMR when it offered for transportation, in commerce, a hazardous material (NA3178, Smokeless powder for small arms, 4.1, PG I), in a UN specification packaging rated for Packing Group II and III; and it allowed an employee to perform a function subject to the requirements of the HMRs, when the employee had not received initial hazardous materials general awareness/familiarization, function specific, safety, and security awareness training, as required.
