Respondent was assessed a civil penalty of $6,860 for three violations of the HMR when it offered for transportation, and transported, in commerce, a hazardous material, and it failed to make available records of periodic retesting as prescribed in 49 C.F.R. § 178.601(1), after manufacturing, marking, and certifying UN 4G fiberboard boxes as meeting the requirements of the HMR; it used a shipping paper not prepared as prescribed by the HMR; and it failed to register as an offeror of hazardous materials as prescribed by 49 C.F.R. § 107.608.
