Appellant was assessed a civil penalty of $13,280 in five payments of $2,656 for five violations of the HMR when it filled and offered for transportation, and transported in commerce, hazardous materials gases in DOT-specification cylinders when the cylinders were overdue for periodic requalification; it represented, marked, and certified DOT-specification cylinders as having been successfully requalified in accordance with the HMR when it did not hold a current requalification identification number (RIN), and it failed to maintain complete and accurate daily records of cylinder requalification; it offered for transportation and transported in commerce hazardous materials in a bulk quantity and failed to develop a security plan; it allowed its employees to perform functions subject to the requirements in the HMR, while failing to provide each employee with general awareness, function specific, safety, and security awareness training and without creating training records; and it offered for transportation and transported in commerce, a hazardous material (UN 1075, Liquefied Petroleum gas, 2.1), while failing to retain shipping papers and failing to indicate the total quantity of hazardous material carried.
