Respondent was assessed a civil penalty of $11,208 for three violations of the HMR when it represented and certified UN 4G fiberboard box specification packaging as meeting the requirements of the HMR when failing to properly conduct testing by not applying the required weight during the stacking test as prescribed under 49 C.F.R. § 178.606; it represented and certified UN 4G fiberboard box specification packaging as meeting the requirements of HMR while failing to notify customers of closure instructions that provide for a consistent and repeatable means of closure that is sufficient to ensure the packaging is closed in the same manner as it was tested by describing closure as "hand tightened"; and it represented and certified UN 4G fiberboard box specification packaging as meeting the requirements of the HMR while failing to keep complete testing records by failing to provide a full description of the packaging design type in the design qualification test.
