Respondent was assessed a civil penalty of $6,300 for one violation of the HMR when it offered a Packing Group II corrosive hazardous material for transportation in commerce in combination packages which were not authorized for this material because this package design (1) was originally certified only for Packing Group III materials having a lower gross mass and was fabricated by a different box manufacturer, and (2) had not been tested or retested within the two year period before the packagings were fabricated.
