Respondent was assessed a civil penalty of $14,350 for three violations of the HMR when it shipped oxidizing and corrosive hazardous swimming pool and spa chemicals without indicating that the products are hazardous materials by marking or labeling the outer packagings and providing shipping papers to the carrier as required (violation No. 1); in packagings which were not authorized for these materials (violation No. 2); and when its employee who shipped the materials had not received hazmat employee training within the past three years (violation No. 3).
