Respondent was assessed a civil penalty of $23,100 for four violations of the HMR when it offered for transportation, and transported in commerce, hazardous materials gases when the cylinders were overdue for inspection; offered for transportation and transported in commerce hazardous materials gases while using a shipping description with two or more required elements missing, failing to mark the proper name and identification number on packages, failing to label packages, and failing to properly placard a vehicle; offered for transportation and transported hazardous materials in commerce in a quantity requiring placarding, while failing to register with the Associate Administrator for Hazardous Materials Safety as a shipper of hazardous materials; and allowed its employees to perform a function subject to the requirements in the HMR, while failing to provide each employee with general awareness, function specific, safety, and security awareness training and without creating training records.
