Respondent was assessed a civil penalty of $5,375 for two violations of the HMR when it filled, offered, and transported, in commerce, a hazardous material in IBCs that were out of test and in UN standard 1H1 marked and certified drums that had not been closed in accordance with the manufacturer’s closure instructions.
