Respondent was assessed a civil penalty of $20,300 for four violations of the HMR when it offered for transportation, in commerce, a hazardous material (UN1263, Paint related material, 3, PG II), and it allowed its employees to perform a function subject to the HMR, when general awareness/familiarization, function specific, safety, and security awareness training was not conducted at least once every three years, and training records were not maintained; it utilized shipping papers that failed to list a proper shipping name and description, and listed additional information, interspersed within the shipping description; it utilized unauthorized non-UN standard packaging, when specification packaging is prescribed; and it failed to close the package in accordance with the manufacturer's closure instructions.
