Respondent was assessed a civil penalty of $1,192 for two violations of the HMR when (1) it offered for transportation in commerce a shipment described as “FLAMMABLE LIQUIDS, NOS, (METHYL ALCOHOL AND NITROMETHANE), 3, UN1993, PG II” in non-bulk packagings having a gross aggregate weight of 3,996 pounds, when it was not registered with PHMSA and had not paid the applicable registration fee, and (2) its employee performed functions subject to the requirements of the HMR when the employee prepared shipping papers for shipments more than three years after the employee’s most recent hazmat employee training in April 2004.
