Respondent was assessed a civil penalty of $11,800 for four violations of the HMR when it represented, marked, certified, and offered specification UN 1A2/Y and UN 1A1/Y steel drums as being reconditioned when the drums had not been leakproofness tested and cleaned to the base material, and restored to their original shape and contour; represented and offered steel drums marked UN 1A2/Y and UN 1A1/Y as meeting the requirements of the HMR, while failing to ensure the packaging contained legible specification markings; represented and offered steel drums marked UN 1A2/Y and UN 1A1/Y as meeting the requirements of the HMR, while failing to ensure the packaging contained legible specification markings; and it represented, marked, certified and sold reconditioned steel drums, marked UN 1A1/Y and UN 1A2/Y, as meeting the requirements of the HMR while allowing an employee to perform a function subject to the requirements of the HMR when hazardous materials training records were not created and retained.
