Respondent was assessed a civil penalty of $8,500 for three violations of the HMR when it offered for transportation in commerce Class 3 and Class 8 hazardous materials on a motor vehicle using DOT special permits 11646 and 12412, while failing to comply with the requirements of the special permits; offered for transportation in commerce Class 3 and 8 hazardous materials while allowing employees to perform a function subject to the requirements of the HMR, while failing to provide employees with function-specific training on special permits; and failure to create function-specific and safety training records; and filled and offered for transportation in commerce various hazardous materials in UN standard marked and certified packagings that had not been closed in accordance with the manufacturer's closure instructions.
