Respondent was assessed a civil penalty of $12,000 for four violations of the HMR when it offered for transportation, and transported, in commerce, a hazardous material: in a quantity requiring placarding of the transport motor vehicle without developing a written security plan; while failing to train its hazardous materials employees in the areas of general awareness/familiarization, function-specific, safety, and security awareness; while failing to provide a shipping paper including the proper shipping description; and in a quantity requiring placarding of the transport motor vehicle while failing to register as an offeror and carrier of hazardous materials.
