Respondent was assessed a civil penalty of $18,288 for four violations of the HMR when it offered and transported, in commerce, hazardous materials without shipping papers, package markings, or labels; allowed employees to perform a function subject to the requirements of the HMR when the employees had not received hazardous materials general awareness, function-specific, safety, and security awareness training; offered for transportation, in commerce, hazardous materials accompanied by shipping papers that contained incorrect identification numbers within the basic shipping descriptions, inconsistent additional information, and without a shipper’s certification; and offered for transportation, in commerce, hazardous materials in a quantity requiring placarding, while failing to register as a shipper of hazardous materials.
