Respondent was assessed a civil penalty of $10,546 for four violations of the HMR when it filled a DOT Specification 57 portable tank with flammable paint when the tank had not been reinspected and retested in the past 2½ years and offered the filled tank for transportation in commerce (violation No. 1); offered for transportation in commerce a shipment of hazardous materials having a gross aggregate weight greater than 1,000 pounds, so that placards were required to be affixed to the transport vehicle, when Respondent had not registered with PHMSA and paid the registration fee (violation No. 2); allowed employees to perform functions subject to the requirements in the HMR when the employees had not received recurrent hazmat employee training within the past three years (violation No. 3); and offered for transportation in commerce a flammable liquid, corrosive hazardous material accompanied by a shipping paper that did not list an emergency response telephone number (violation No. 4).
