Docket Order: PHMSA-2009-0396

Respondent was assessed a civil penalty of $9,800 for three violations of the HMR when it offered for transportation in commerce and transported in commerce a corrosive hazardous material when it failed to submit an written report of a hazardous materials incident (violation No. 1); failed to properly describe the material on a shipping paper (violation No. 2); and when it packaged the material in used plastic drums which were not authorized because the drums had not been leakproofness tested before reuse and, in one case, the drum was not marked with its minimum thickness (violation No. 3).  A warning was issued for a fourth alleged violation, as proposed in the Notice of Probable Violation.
