Respondent was assessed a civil penalty of $10,500 for five violations of the HMR when it reconditioned, represented, offered, and sold a packaging or container as meeting the requirements for a UN specification packaging, when a leakproofness was not performed as part of the reconditioning process; represented, marked, certified, reconditioned, and offered UN specification drums as meeting the requirements of the HMR, while failing to mark the reconditioned drums; represented, marked, certified, reconditioned, and offered UN specification drums as meeting the requirements of the HMR, while failing to mark the reconditioned drums; represented and offered composite Intermediate Bulk Containers, marked as "UN31HA1," as meeting the requirements of the HMR, when the packagings were not marked as being subjected to routine maintenance; and it offered UN specification packagings or containers for sale while allowing an employee to perform a function subject to the requirements of the HMR, while failing to provide general awareness, function-specific, and security awareness training.
