Respondent was assessed a civil penalty of $5,400 for one violation of the HMR when it offered for transportation in commerce by vessel a motor vehicle powered by an internal combustion engine using liquid fuel that has a flash point less than 38ºC (100ºF), a hazardous material, when the fuel tank was not empty and the engine had not been run until it stalled for lack of fuel, without declaring the vehicle as a hazardous material or meeting the conditions for an exception from other requirements in the HMR.
