Respondent was assessed a civil penalty of $7,875 for one violation of the HMR when it manufactured, marked certified, sold, and offered for transportation, in commerce, UN specification plastic drums marked UN1H2, as meeting the HMR requirements when the packaging was incapable of passing the drop test prescribed in § 178.603.
