Respondent was assessed a civil penalty of $6,960 for two violations of the HMR when it represented, marked, and certified a DOT specification cylinder as having been successfully requalified when the cylinder met criteria for condemnation, in that the cylinder failed to qualify within two approved tests, failing to increase test pressure by 10% or 100 psi, whichever is less, . when a test is repeated due to equipment malfunction, and failing to calibrate test equipment to within 500 psi of the actual test pressure tested; and represented, marked, and certified a DOT specification cylinder as having been successfully requalified while failing to maintain complete and accurate test records, specifically, failing to provide a reason for repeat test, and include the actual dimensions and cylinder owner.
