Respondent was assessed a civil penalty of $4,700 for three violations of the HMR when it represented, certified and marked DOT specification and special permit compressed gas cylinders as having been successfully retested in accordance with the HMR, when it failed to maintain complete and accurate records of inspection and retest (violation No. 1); it retested DOT specification 3AA-1800 cylinder at less than the required minimum test pressure (violation No. 3); and it failed to create and maintain records of hazmat employee training for its retest operator (violation No. 4).
