Docket Order: PHMSA-2009-0119

The Chief Counsel found that EVE Battery had committed the following three violations of the HMR. EVE offered for transportation in commerce lithium batteries, 9, UN3090, II, without a hazardous material shipping paper and without providing an emergency response telephone number, and failed to mark and label the packaging with the proper shipping name and identification number; (2) without testing and meeting the lithium battery requirements in the UN Manual of Tests and Criteria, and (3) in unauthorized combination packagings. The order assessed a civil penalty of $34,800.00.
