Appellant was assessed a civil penalty of $16,600 for three violations of the HMR when it offered for transportation, in commerce, lithium batteries having an aggregate equivalent lithium content greater than 25 grams, and it failed to describe the lithium batteries as hazardous on a hazardous materials shipping paper and failed to mark or label the outer packagings as required; the lithium batteries were shipped in fiberboard boxes which were not authorized because they were not marked as meeting a UN performance standard in the HMR; and its president, who is the only employee that prepared lithium batteries for shipment, had not received hazmat employee training.
