The Chief Counsel's findings were affirmed. Appellant was assessed a civil penalty of $12,000. Appellant may pay the amount in one lump sum or in monthly payments of $1,000 for 12 months. In the Chief Counsel's order, Respondent was assessed a civil penalty of $12,000 for five violations of the HMR when it offered for transportation, and transported, in commerce, a large bulk quantity of Division 2.1 hazardous material without developing a security plan; offered for transportation, and transported, in commerce, a hazardous material (UN1075, Liquefied petroleum gas, 2.1), without listing an emergency response telephone number on the shipping paper; represented, marked, and certified DOT specification cylinders as successfully requalified in accordance with the HMR without maintaining a current RIN issuance letter; represented, marked, and certified DOT specification cylinders as successfully requalified in accordance with the HMR without maintaining the required information on a requalification record for each cylinder requalified or visually inspected; and represented, marked, and certified DOT specification cylinders as successfully requalified in accordance with the HMR without maintaining the required facility records where the requalification is performed.
