Respondent was assessed a civil penalty of $26,680 for seven violations of the HMR when it represented that reconditioned steel drums meet the HMR requirements when the drums did not meet the minimum thickness requirement; represented and marked that reconditioned steel drums meet the HMR requirements without restoring the drums to their original shape and contour, and without cleaning the drums to their base metals and removing labels; represented and marked that a reconditioned steel drum meets the HMR requirements while marking on the drum a greater performance capability than that for which the original design type had been tested; allowed employees to perform functions subject to the HMR without providing general awareness/familiarization, function-specific, and security awareness training to hazmat employees; represented and sold UN standard lAl drums as meeting the HMR requirements without maintaining the required notification records; represented that reconditioned steel drums meet the HMR requirements without marking the drums in the correct sequence; and represented that a reconditioned steel drum meets the HMR requirements without marking the nominal thickness of the drum.
