Docket Order: PHMSA-2009-0274

The Chief Counsel assessed a civil penalty of $11,925 for two violations of the HMR, including offering a hazardous material (Compressed gas, oxidizing, n.o.s. (90% oxygen, 10% nitrogen), 2.2 (5.1), UN3156) for transportation in commerce: (1) while failing to declare the material as hazardous and failing to provide shipping papers, and failing to mark and label the package(s) as containing hazardous materials; and (2) while failing to provide general awareness, function-specific and security awareness training and failing to document safety training.  The Order describes the prompt action by Respondent to correct the undeclared hazardous materials shipment problems.
