Respondent was assessed a civil penalty of $8,150 for two violations of the HMR when it offered for transportation in commerce fireworks, explosive hazardous materials, which had not been tested, and had not been classed and approved by PHMSA (violation No. 1), and when it did not describe the materials as required on a shipping paper and it failed to maintain copies of shipping papers (violation No. 2).
