Respondent was assessed a civil penalty of $17,088 for four violations of the HMR when it transported in commerce a hazardous material, UN1075, Propane, 2.1, in a non-DOT/UN standard storage tank designed for permanent installation when the tank was charged to more than five ( 5) percent of its water capacity, while failing to complete a record of inspection and retain the record for two (2) years, failing to lift the tank with ASME B30.9 slings which must be completely wrapped around the container, failing to use a cradle which ensures that no weight is placed on the supporting legs during transportation, and transporting on a trailer without rear end protection that conforms to the requirements of 393.86 of this title; allowed employees to perform functions subject to the HMR while failing to create and maintain complete records of hazmat employee training; transported in commerce a hazardous material, UN1075, Liquefied petroleum gas, 2.1, contained in a cargo tank motor vehicle (CTMV) when Respondent failed to create and maintain a monthly hose assembly and piping system report for each CTMV; and offered for transportation in commerce a large bulk quantity of UN 1203, Gasoline, 3, PG II, while using a security plan, which Respondent failed to review at least annually.
