Appellant was assessed a civil penalty of $9,950 for three violations of the HMR when offered for transportation, and transported, a hazardous material (UN0336, Fireworks, 1.4G, PG II), in commerce, while failing to package the materials in UN specification packaging; when the material was not identified as hazardous on shipping papers, and when the packages were not marked and labeled, therefore shipping a hazardous material undeclared; and when it allowed its employees to perform a function subject to the requirements in the HMR, while failing to provide each employee general awareness, function specific, safety, and security awareness training every three years.
