Respondent was assessed a civil penalty of $25,110 for six violations of the HMR when it offered and transported in commerce various hazardous materials class 3 and 8, packaged in unauthorized non-UN specification 65-gallon tanks and unauthorized UN standard 55-gallondrums, without markings, labels, and shipping papers; allowed employees to perform functions subject to the requirements of the HMR, while failing to provide each hazmat employee with general awareness/familiarization, function-specific and security awareness training; offered and transported in commerce various hazardous materials packaged in marked and certified UN standard 55-gallon drums that had not been closed in accordance with the manufacturer's closure instructions; offered and transported in commerce hazardous materials contained in UN standard 55-gallon drums while failing to remove the drums from the motor vehicle when discharging the contents of the container; offered and transported in commerce various hazardous materials, while failing to follow the required sequence for listing the basic hazardous materials description on shipping papers; and offered and transported in commerce a quantity of hazardous materials requiring placarding of the transport vehicle, while failing to register as an offeror of hazardous materials with the U.S. DOT, Hazardous Materials Registration Program and pay a registration fee.
