Appellant was assessed a civil penalty of $10,860, payable in 12 monthly payments of $905, for five violations of the HMR when it offered for transportation in commerce corrosive liquid hazardous materials in non-bulk packagings which were not authorized for this material because Respondent failed to complete and close the package in accordance with the manufacturer's closure instructions to assure that all requirements of the marked UN standard, including performance tests, were met; offered for transportation in commerce corrosive liquid hazardous materials which were not accompanied by a shipping paper containing an emergency response telephone number; offered for transportation in commerce corrosive liquid hazardous materials in non-bulk packagings which were not marked with the proper shipping name and UN identification number for this material and to which hazard class warning labels were not affixed; and it allowed employees to perform a function subject to the requirements of the HMR, when records of hazmat employee training were not maintained.
