Respondent was assessed a civil penalty of $13,500 for two violations of the HMR when (1) it offered for transportation in commerce and transported in commerce a quantity of Division 1.4G fireworks, explosive hazardous materials, containing greater than 454 kg (1,001 pounds) aggregate gross weight, in a transport vehicle or freight container which was not placarded as required, and when the accompanying documentation failed to indicate the number of packages in the shipment or include a packing group in the shipping description, and failed to include an emergency response telephone number, and (2) it had not registered with PHMSA and paid the registration fee.
