Respondent was assessed a civil penalty of $5,285 for two violations of the HMR when it offered for transportation and transported in commerce Division 1.3G fireworks, explosive hazardous material, that were not approved and were forbidden for transportation because they were manufactured by a person other than the person to whom the approvals were issued (violation No. 1), and allowed an employee to perform a function subject to requirements in the HMR, when Respondent had not created and retained records that the employee had received hazmat employee training (violation No. 2).
