Respondent was assessed a civil penalty of $5,375 for three violations of the HMR when it offered fireworks, a division 1.4G (explosive) hazardous material, for transportation in commerce and transported fireworks in commerce in packagings which were not secured against movement within the vehicle on which they were being transported (violation No. 1); transported a quantity of fireworks in commerce which required placards to be affixed to the transport vehicle, when it had not registered with PHMSA and paid the registration fee (violation No. 2); and allowed an employee to perform a function subject to the requirements of the HMR, when records of the employee's required hazmat employee training had not been created and retained (violation No. 3).
