Compromise Order - 23-0005-PM-EA - Zacros America Inc

On October 11, 13, and 20, 2022, PHMSA' s Investigator conducted an inspection at Respondent's Newark, Delaware facility, pursuant to 49 U.S.C. § 5121 and 49 C.F.R. § 107.305. Based on a preliminary assessment of the apparent nature, circumstances, extent, and gravity of the probable violation, as set forth in the inspector's report, on June 2, 2023, an attorney from PHMSA's Office of Chief Counsel issued a Notice of Probable Violation (Notice) alleging one (1) violation of the HMR and proposing a $8,400 civil penalty.

Compromise Order - 23-0151-SH-SO - Battery Source #20

On June 27 and 29, 2023, an Investigator from PHMSA's Office of Hazardous Materials Safety Field Operations ("OHMSFO") conducted inspections at Respondent's facilities in Mobile, Alabama, pursuant to 49 U.S.C. § 5121 and 49 CFR § 107.305. PHMSA’s Investigator
reported two (2) alleged violations of the HMR.

Respondent agrees to pay a total civil penalty of $13,500, as full satisfaction of the civil penalty proposed in the Notice.

Compromise Order - 21T-0410-CA-EA - Lake Champlain Transportation Company

In response to a complaint, on October 20 and 21, 2021, PHMSA's investigators conducted a compliance inspection pursuant to 49 U.S.C. § 5121 and 49 C.F.R. § 107.305. PHMSA's investigators reported alleged violations of the HMR. Accordingly, the matter was referred to PHMSA's Office of Chief Counsel for review, with a civil penalty of $950, as referenced in the ticket. In response to the exit briefing. Respondent provided evidence of its registration, a copy of a retained shipping paper, and developed procedures and training materials for acceptance of shipping papers.

On July 12, 2022, an Investigator from PHMSA's Office of Hazardous Materials Safety Field Operations ("OHMSFO") conducted a routine compliance inspection at Respondent's business pursuant to 49 U.S.C. § 5121 and 49 C.F.R. § 107.305. PHMSA's investigator reported two (2) alleged violations of the HMR.

On June 20, 2024, an Investigator from PHMSA's Office of Hazardous Materials Safety Field Operations ("OHMSFO") conducted a routine compliance inspection at Respondent's business pursuant to 49 U.S.C. § 5121 and 49 CFR § 107.305. PHMSA's Investigator reported two (2) alleged violations of the HMR.
