On March 21, 2024, Investigators from PHMSA’s Office of Hazardous Materials Safety Field Operations ("OHMSFO") conducted a compliance inspection at Respondent's business pursuant to 49 U.S.C. § 5121 and 49 CFR § 107.305. PHMSA's Investigator reported two (2) alleged violations of the HMR.

Based on a preliminary assessment of the apparent nature, circumstances, extent, and gravity of the probable violation, as set forth in the Investigator's report, on August 9, 2024, an attorney from PHMSA's Office of Chief Counsel issued a Notice of Probable Violation ("Notice") alleging one (1) violation of the HMR and proposing a $5,040 civil penalty, which included a reduction for corrective action.

In its April 16, 2024, correspondence Respondent addressed the actions it has taken to correct the violations alleged in this Notice and to prevent future violations of the HMR.

By this Order I find that O'Brian Healthcare, Inc. committed one (1) violation of the Hazardous Materials Regulations (HMR), 49 CFR Parts 171-180. Accordingly, I assess Respondent a civil penalty of $3,780 for these violations.
