This notice solicits comments on the merits of a petition for rulemaking filed with RSPA and FHWA proposing to amend Title 49 of the Code of Federal Regulations to require each person offering a hazardous material for transportation, by highway, in cargo tanks to obtain documentary proof that the motor carrier possesses the minimum level of financial responsibility currently prescribed by regulation (49 CFR Part 387); that such persons maintain such proof for a certain period of time; and that such proof should be produced for review upon reasonable request by a member of the public. Comments are also sought on a corresponding amendment that would require such documentation be tendered by motor carriers to those shippers for whom they transport hazardous materials.
